What is an Expungement of an Oregon Arrest or Conviction?
An Expungement is a legal process which seals your arrest and/or conviction record permanently. All the expunged records are generally destroyed. After your Oregon arrest and/or conviction is expunged, your criminal records cannot be accessed in background checks, for civil use, or for general law enforcement purposes. In most cases, expunged records in Oregon are never viewed again. The purpose of the Oregon Expungement statute, ORS 137.225, is to put people back in the position they were in prior to being arrested and/or convicted.
What Kind of Arrests and Convictions can be Expunged?
Normally, records in any Oregon court, law enforcement, or criminal justice agency can be expunged. Oregon court records regarding a person's eligible apprehension, arrest, detention, trial or conviction within the criminal justice system are eligible for Expungement. After the Oregon Expungement process is completed by our attorneys, a person's record of arrest and/or conviction is erased and legally deemed not to have occurred.
Who is Eligible for an Expungement?
Generally, a criminal conviction may be expunged three years after the conviction occurs if the proceeding involved a single conviction. An arrest not resulting in a conviction may generally be expunged after the charge was dismissed or one year after the arrest occurred if no charge was filed. There are limits to the types of Oregon offenses which can be expunged. There are other limitations regarding Oregon Expungements which are numerous to list. How Long Does an Oregon Expungement Take?
Normally, the Oregon Expungement process will take approximately 3-4 months. A criminal background check is conducted to confirm eligibility for Expungement, paperwork is prepared and filed by your attorney in the applicable Oregon court, and notifications are sent to various law enforcement, district attorney, and court offices.
After the court receives the required documents, a hearing date may be set. In most cases, a hearing is not required. However, if there is an objection to your request for Expungement, legal briefs and oral argument at the hearing may be required.
Can an Expungement Allow Me to Lawfully Possess Firearms?
Yes. Because an expungement removes the criminal conviction from your record, it may allow you to purchase or possess firearms. An Oregon Expungement may also remove the Federal disqualification for convicted felons purchasing or possessing firearms.
